This notice is to inform you how Newry, Mourne and Down District Council (NMDDC) processes your information (‘personal data’) when you apply for a job with NMDDC, including the application process and pre-employment checks. NMDDC is the data controller for the processing set out in this notice, which means we decide how and why your data is processed, either on our own or jointly with another organisation.

Where you apply for a role through a recruitment agency, your personal data is shared with NMDDC by that agency. These organisations have their own data-processing practices and responsibilities, and they process your information in accordance with their own privacy notices and contractual arrangements they hold with NMDDC.  For further information on how these organisations process your personal data, please refer to their respective privacy notices.

The type of personal information we collect 

We currently collect and process the following information:

Personal details such as name, date of birth, national insurance number, personal contact information, address 

Information we require to verify your identity such as passport, driving licence or other identity documentation 

Eligibility – nationality and immigration status and evidence of right to work in the UK

Employment history

Information relating to qualifications, licences and professional memberships

Evidence of how you meet the requirements of the job including application form; interview notes; internal notes; the results of any written or online assessments such as technical, ability, aptitude or psychometric tests; correspondence

Diversity and inclusion information

Disability and reasonable adjustment requirements

Information about your current level of remuneration, including, where applicable, benefit entitlements.

We may also collect, store and use the following special and sensitive personal information: 

Racial or ethnic origin, religious beliefs, sexual orientation and gender identity (including ensuring meaningful equal opportunities monitoring and reporting)

Medical information including physical health or mental condition

Where applicable, criminal offences, including alleged offences, criminal proceedings, outcomes and sentences.

We will only collect information about criminal convictions if it is appropriate for the employment role and where we are legally permitted or required to do so. We collect information about criminal convictions as part of the recruitment process or may be notified of information directly by you or a third party during your recruitment or employment. We will use information about criminal convictions and offences in the following ways:

To comply with the Council’s statutory obligations on safer recruitment practices

To help us make safer recruitment decisions  

To safeguard employees and service users of the Council.

If you are shortlisted for a position, or you receive a conditional offer of employment, we may collect, hold and use the following additional types of personal data about you.
 
Pre-employment check information which may include:

References - your current/most recent employer will be asked to provide information with regards to your employment and suitability for the post including whether there are any on-going disciplinary investigations or current sanctions.  

Verification of qualifications.

Right to work checks and related documents.

Criminal records checks, where relevant to the post applied for.

If you pass your pre-employment checks, we will collect the following information about you to finalise your contract and create your employee record:

Date of birth

Sex

National insurance number

Personal documentation (Passport/Driving Licence)

Bank account details

Emergency contact details

Next of kin details

Medical information including physical health or mental condition, sickness and occupational health records

If you are a carer (but only where you have opted to provide this information)

We will collect information about any relevant benefits or pensions you receive, and any student loans you have, to report this information to His Majesty’s Revenue and Customs per our legal obligations.
 
We will also collect your marital status, which along with other details will be sent to the Northern Ireland Local Government Officers’ Superannuation Committee (NILGOSC) who administer the Local Government Pension Scheme (LGPS) in Northern Ireland to auto-enrol you in the scheme unless you opt out of it.

How we get your personal information

Most of the personal data we process during recruitment is supplied to us by our contracted recruitment partners, either directly or via the online recruitment platforms and agency networks they manage.
 
We also receive personal data from recruitment agencies operating outside those arrangements, such as specialist search and selection providers engaged for certain roles. This may include your CV, application details and any supporting documents they hold on your behalf.
 
We collect information that you provide to us during an interview or as part of your selection process, such as test results, as well as information obtained through pre-employment checks where applicable.
 
We may obtain additional personal data from the following sources:

from third parties acting on your behalf such as family member(s), advocates, etc

your previous employers and education providers, whom we may ask to provide a reference

external recruitment consultants, whom we may engage for some recruitment campaigns

from our commissioned partners or contractors who undertake work on our behalf

sources of information used for our pre-employment checks, including records of criminal offences

We use the information that you have given us in order to:

Automated Decision Making

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making.

Who we share your personal information with

Our Corporate Privacy Notice sets out the general types of information sharing that the Council carries out to fulfil statutory obligations, legal requirements, and service delivery. Human Resources may share your information with:

the recruiting manager and selection panel

occupational health

human resources support

payroll

IT

expert partners such as employment law solicitors

If external parties are used to support the recruitment and selection process, this will be clearly stated in recruitment correspondence. These parties are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of data.
 
In most circumstances, we will not disclose personal data to third parties without your consent. However, we may share your data where required to meet legal or public function obligations, to pursue debt, for fraud or crime prevention and detection purposes, or in your vital interests, with the following:

suppliers and service providers such as external assessment centre providers

courts, tribunals, and parties to litigation

Organisations granted access to your information must adhere to the Council’s strict terms and conditions, which cover confidentiality, secure handling, appropriate retention, and permitted use of personal data.

Lawful bases for processing your personal data

Depending on the processing activity, we rely on one or more of the following UK General Data Protection Regulation (UK GDPR) lawful bases when we process your personal information:

taking steps prior to entering a contract or performing obligations under your contract of employment (Article 6(1)(b) of the UK GDPR)

performing or exercising general legal obligations we must meet, including duties and rights under employment law, social security law or social protection (Article 6(1)(c) of the UK GDPR)

where it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council, for example fraud prevention and protection of public funds (Article 6(1)(e) of the UK GDPR)

our legitimate interests (or those of a third party), provided your interests and fundamental rights do not override those interests (Article 6(1)(f) of the UK GDPR). Examples include: 
o reviewing CVs, conducting interviews, and verifying qualifications or references to identify the most suitable candidate
o contacting applicants with interview invitations, updates, offers, or logistical details to ensure an efficient recruitment process
o collecting and analysing anonymised diversity information for internal reporting to maintain fairness and comply with equal opportunity commitments
o managing pre-employment tasks such as arranging health screenings and obtaining references

your consent (only where no other lawful basis applies, and where you have a genuine choice and control over whether your information is processed, including the right to withdraw your consent at any time without detriment) (Article 6(1)(a) of the UK GDPR)

Where the information we process is special category data, the additional bases for processing we rely on are:

purposes of carrying out the obligations and exercising specific rights of the Council or of you in the field of employment (Article 9(2)(b) of the UK GDPR).

establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity (Article 9(2)(f) of the UK GDPR).

reasons of substantial public interest based on UK law, in the exercise of the official authority vested in the Council (Article 9(2)(g) of the UK GDPR).

purposes of preventive or occupational medicine or for the assessment of the working capacity of the employee (Article 9(2)(h) of the UK GDPR), such as health information for occupational health assessments.

Keeping your personal information

Your information is stored securely in both electronic and physical form at the Council’s Downshire Civic Centre, Ardglass Road, Downpatrick, BT30 6GQ
We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including satisfying any legal, accounting, or reporting requirements.
 
For recruitment purposes:

Unsuccessful candidate data (including application forms, CVs, interview notes, and assessment results) will normally be retained for up to 24 months after the date of application, unless a longer period is required for an extended reserve list or to resolve a complaint or legal claim.

Successful candidate data will be transferred to your personnel file and retained in accordance with our Employee Privacy Notice and retention schedule.

Equality monitoring information will be anonymised and retained for reporting purposes only.

After these periods, your data will be securely deleted or anonymised so that it can no longer identify you.

Your data protection rights

Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances. 
Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances. 
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
 
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Making a complaint

If you have any concerns about the way we use your personal information, we would ask you to come to us first for help.  You do, however, have the right to complain to the Information Commissioner’s Office (ICO).  The ICO regulates compliance with the UK GDPR, the Data Protection Act 2018 and Data Use and Access Act 2025 within the UK and may carry out an assessment, audit or investigation to establish whether we are compliant with the legislation.
